Ninth District Federal Court Says Prop 8 Is Bullshit – Let’s Not Fuck This Up California


Marriage equality got another shot in the arm today as a Ninth Circuit Federal Court ruling came in 2-1, affirming a prior ruling that California’s Proposition 8 was unconstitutional. For those out of the loop, Prop 8 was the official ban on gay marriage in California. It was passed nearly four years ago with a lot of outside help from the Mormon church, who has been on a crusade against gay marriage for years and years now.

It makes you wonder what would have happened if Joseph Smith was gay and took many husbands, doesn’t it?

Regardless of the religious interloping done in 2008, the controversial Proposition was immediately appealed, as will be today’s decision. The fact is that it’s going to be a long, hard fight to win the fight. As is the United States’ custom, it takes years of pushing and pushing to get real freedom installed for a group of people who were initially shut out of the Civil Rights Give Away Party that the founding fathers had back in the late 18th century.

But if we’ve learned anything from the fight to abolish slavery and Jim Crow Laws and  the fight to give women the right to vote, equal pay and control over their own genitalia, it’s that these things take time.

But do they really have to?

Maybe it’s wishful thinking on my part, but I’d like to think that the large resistance to Marriage Equality in this country is coming from the fact that we have a large number of old-school (read: “bigoted”) Baby Boomers who just can’t fathom that most of us truly don’t give a fuck who anyone fucks. (Fuck) I can’t help but notice that people of Generation X, Y, Z and Whatever-The-Hell-Comes-Next are much more tolerant and accepting of the idea of gay marriage.

That’s usually how it works; one generation learns from another’s mistakes. So isn’t interesting that a lot of people who were appalled by how African-Americans were treated in the South during the 1940s, 50s and 60s are now trying to make damn sure gay folks can’t get married?

So the natural conclusion is that over time, as more and more rulings like this morning’s in the Ninth Circuit are handed down, society will evolve. But that’s not enough. The rest of us, those of us who know what an utterly stupid idea that gay people can’t married is, have to be willing to continually push the boulder up the hill until we can get it to the apex and shove it over. The winds of change cannot be ignored forever, but we all have to remind ourselves that the battle is not over, that the fight will be tough, but that we can succeed.

We have to succeed. The greatest thing about this Great American Experiment of ours, we have the ability to grow and change for the better. When we were formed, women and African-Americans could not vote. We’re still not totally equal on those two fronts, but it doesn’t mean we can’t bring another group into the fold.

So what’s next? Californians have to not fuck this up, that’s what’s next. We have to tell the Mormon Church that their crusade of hate stops here. We have to not only repeal Prop 8, we have to pass a new proposition that actually condones and sanctifies marriage in the eyes of our great state. It’s been a travesty of epic proportions that states like Iowa (no offense Iowa, I love you guys) have laws allowing for gay marriage and California, the bastion of Liberal Hedonism, the Mecca of Sin and Communism, does not allow gay people to get married.

Maybe today’s ruling was just one step forward. But in times like these we need to be thankful that it was not a step in the other direction, and remember that we still have many more steps to take.

Don’t fuck this up, America.

Seriously, don’t fuck this up, America.
